Help and advice

When approaching a case as a litigant in person, the single most important piece of advice I can offer here is to separate your emotions from the facts. Courts rely entirely on evidence and established procedures, not on who is morally right or most upset or who is the narcissistic parent. Approaching your case objectively is your greatest asset in the court room.

  • Understand the Rules - The court will expect you to follow the same rules (Family law rules) so take the time to familiarise yourself with them, understand what the welfare checklist is and how the judge will refer to it.
  • Visit a Court - To appreciate the atmosphere of being in one, this will help if you’re particularly nervous about the process.
  • Never Miss a Deadline! - Try to stick to what the courts ask in terms of directions and deadlines, as failing to do so can result in serious consequences in your case.
  • Get Free or Affordable guidance - This is your battle but in terms of the war you do not have to do everything alone. Always look for guidance to help you understand your legal position and take advantage of free consultations.  
  • Seek Support - The Support Through Court can assist with court attendance and drafting basic legal documents, I have previously worked there and recommend this always for those facing court alone. 
  • Focus on Communication - Be concise, stick to the facts! and do not use inflammatory language in your communications with the opposing party(be polite in your responses)
  • Listen actively to the Judge - Judges cannot act as your lawyer, but they will provide practical directions in the case. So always pay particular attention to what they say and act promptly on any of their recommendations.
